How to pursue case of 2013 without disturbing case of 2016

02-Jun-2023 (In Criminal Law)
In my case of 2016 chargesheet has already been filed.Summons have been issued but they haven't taken bail. Since I want to sort this through mediation can I file DV Act. Secondly there is another related case I filed in 2013 under section 354B, on one of the accused of this case of 2016. In that case also they are just taking dates and it is being prolonged unnecessarily. Can I pursue this case of 2013 without disturbing the present case of 2016 ?

As per the facts provided by you, if both the cases are of different nature as in, filed against the different person(s) involving different questions of law. As the case of 2016, if you want to solve the said case through mediation then you can file an application for the same in the court in which the trial of the said case is going on. However, regarding the case of 2013, as you stated that one of the accused is common in both the cases of 2013 and 2016, thus, both the cases will be tried separately as they involve different grounds and question of law, i.e., one includes section 354B and the other one includes the Domestic Violence Act.
