How to prove police action wrong

One of the jawans serving in j&k who came on leave falsely implicated in' deterring SI of police from doing his duty'. In actuality, the jawan was hurled abuses when he entered Police Station at the outset.When SI was about to hit him, the jawan tried to stop him. SI implicated him under the above false charges and remanded him to 14 days with his links in judiciary. The life of the jawan made hell by putting him in jail.While on leave, he cannot get any support from Unit which is in J&K. How to prove the police actions are wrong?

Police do such kind of illegal acts. But what are remedies I can explain you in brief. First of all take an FIR copy and approach the appropriate court and file a bail application. Once the bail is granted than you can proceed further. You can file a complaint against the police officer and take all the necessary steps so that he would learn a lesson for what he has committed.
Secondly you can approach the concerned high court for quashing the said FIR. You have to face the trial before the concerned court and after the verdict of the district court you have the right to challenge the court's order if the order is against you. Lastly I can only say that consult with any lawyer. Best of luck.

It depend on the contents of FIR, jawan can also file a cross case on SI by invoking 156/3 if police fail to loadge a complaint. Simultaneously the jawan can also give a complaint to the higher officer of Police.

Hi, this is not uncommon for police. Our many military men are daily harassed at the hands of police. However, the proper action would lie against the policemen. You need to consult me. I will try to save the jawan and also cases will be filed for proper compensation for the harassment suffered by the jawan.
