How to get bail under sec. 376 for false rape charges

My brothers ex gf put allegation that he raped her and also took money and gold together of value 10 lakhs and said he will use this money to buy a new flat where they will stay after the marriage but we have all the proof which show that my brother bought thia flat taking help from my father and maternal uncle and rest of the amount is on home loan also that girl doeant have any proof of that amount and gold jewallery. my brother got arrested on 16 may 2017 and his bail plea is in seesion court.i just want to know how and when my brother will get the bail and what we should do next.

You have to apply for bail in the sessions court and basically take the evidences alojg with you and let the sessions judge decide the bail and atleast get everything recorded in the bail order so that high court can look at that

Dear, THe court will only grant bail if the court finds the merit in the case and in favour of your brother/ Generally the courts of sessions are reluctant in granting bail. But untill and unless you provide us the FIR copy we cannot suggest you.
