How to find out whether FIR u/s 498 is fake or real

16-Mar-2023 (In Criminal Law)
How can i know the 498a FIR against our entire family is fake or true? Because there is no arrest, no FIR copy, not showing online after 3 months. The girl used to call police evernight at 2.00 am. by dialling private number of the police before 498a. but there is no official record in police station. Police just tried to defame us by coming to our kitty party of our caste ladies and my younger brother at his office. We have taken FIR Copy through RTI but still i have doubt that it is fake. How can i confirm it is fake or true? Entire episode is looking preplanned fraud by our own relatives. How to bust that fraud? We have given written complaint to the police commissioner but no action has been taken as yet.

Go and meet your area police commissioner personally and narrate the whole story,he will definitely help you in the matter and if you or your family members are not involved you should not worry. You can give applications against the girl who is involved in such activities to Police commissioner/ police inspector of your area.

If you got the copy of FIR under RTI, then it is the correct copy, because police cannot provide false information under RTI. However, if you still want to confirm if that FIR is correct or not, then it is mandatory for the police to send the copy of FIR to the concerned Judicial Magistrate within 24 hours, and the copy of that FIR would be available in the court of your jurisdiction. From were you can check and obtain certified copy of FIR.

If the FIR is registered against you, then you can file Petition in High Court for quashing/ cancelling the FIR . You need to share the COpy of FIR which you got under RTI, so we can assess if this is a good case for quashing.
