How to file a Domestic Violence case against husband and in laws
14-Oct-2023 (In Criminal Law)
My husband harassing me on silly reasons. Scolding and beating. I am carrying, but husband's sister also scolding and beating me, so I moved to my mother's house as the delivery date is approaching. Now can I claim maintenance and how much can I claim?. He police constable, so what action can I take and how to proceed.? I am Hindu.
Dear Querist, the fact that your husband is a police officer has no bearing on the matter. Maintenance can be claimed independatly under the Domestic Violence Act as well as under section 125 CRPC. In addition, if you were to file for divorce, maintenance would also be given pending the divorce proceedings. The Courts consider the income of the parties while awarding any maintenance or compensation. In your case, the Court would be inclined to grant some relief immediately under the Domestic Violence Act. Please feel free to get in touch if you require any further clarifications. Best Regards, Dhruv Banerji.
better to visit women protection office or you can meet with an advocate in person so you will get proper response and you need to file a DVC case as well as maintenance case against your husband with the help of advocate or through women protection office.
