How to apply for passport in case there is a pending case

I have pending police, had a fight with police constable...it's been almost 5 years and charges have not been proved yet. I got a job offer from Italy and want to apply for a passport. What should I do? It's a question of my carrier. Please help me on this as i am getting mentally depressed bcoz of this.

You can go to abroad by taking court for making passport by giving GSR rules and making an application towards court give undertaking to same
