First of all is your chargesheet isfiled before the court or not is my question which is incomplete in ur query, if yes then you can make an application for adding the names before the hon'ble court and if not then you shld approach the police station for adding the names for the same.

Hello,
That can be done by the investigating officer in the course of investigation. However this cannot be done as per the whims and fancies of the author their has to be concrete proof to implicate a person in said offence

Section 319(1) of the Criminal Procedure Code, 1973 (Cr.P.C.), lays down that even during the trial stage the name of a new accused person can be added to the list of the accused persons if the evidence shows his involvement. Section 319(1) of Cr.P.C. is reproduced below:

“319. Power to proceed against other persons appearing to be guilty of offence.—(1) Where, in the course of any inquiry into, or trial of, an offence, it appears from the evidence that any person not being the accused has committed any offence for which such person could be tried together with the accused, the Court may proceed against such person for the offence which he appears to have committed.”

Thus, it should be clear that, even after the registration of the FIR, the name of a person can be added as an accused person in a case at any stage of the investigation (or further investigation after filing of charge sheet) or even during trial if there is evidence to support his involvement in the offence.
