13-Aug-2023 (In Criminal Law)
Can a case can be filed on a married man if he is involved in a relationship with a unmarried lady . What court accepts as proof in case of adultery . Can this married man's wife make his husband get punished in the court by providing some call records and her suspicion and by citing his behaviour as evidence to adultery . What is maximum punishment can be given to this man in the court and how his wife can prove his adultery and can court force them to live together?
Section 497 of IPC states that, "Whoever has sexual intercourse with a person who is and whom he knows or has reason to believe to be the wife of another man, without the consent or connivanc of that man, such sexual intercourse not amounting to the offence of rape, is guilty of the offence of adultery.
Also, adultery does not necessarily mean that your spouse had sexual intercourse, it could also mean you were sexually intimate. Therefore, most courts do not require proof of the adulterous act itself. Instead, most courts require you to prove: First, that your spouse had a disposition to commit adultery.
Maximum sentence is five years or fine or both.
