How can a false FIR be rectified registered in police station
17-Jul-2023 (In Criminal Law)
Complaint given to police is : one day he had lost his cow, next day he was searching for his cow with his 4 friends while he was searching for his cow some how he came to know that his cow had came to my agricultural field and it was eating my crop so i had tied his cow in my home (note: he has not written- by whom and how he came to know that), so far inquiring about his cow he came to my house premises along with his 4 friends and while he was inquiring about the issue with my father i came out of my home scolding him with bad words related to his religion and i hit his face from my hand... now charge sheet is filed... in the FIR of the complaint given against me the police has written an extra sentence in complaint summary section of FIR which is not written by the complainant in the complaint written by him so hence we can tell that police has advised compliant to write complaint. What should we do?
Hi, As the Charge Sheet is Filed by the Police, It will not get quashed by the Court in the first instance. Hence during your first appearance in the court, please make a submission that the charge sheet filed is malafide in nature and show cause for the same. As a complainant you have all the rights to question the charge sheet filed which is away from true facts and request/make an application to the Hon'ble Court to Quash the Charge Sheet Filed by Police.
Please file your written version of objection and counter to the charge Sheet objecting strongly and opposing the application vehemently for the reasons that you rely upon and the court is convinced about. Ask for a re-investigation in the matter through another police officer.

Hi...If charge sheet is already filed then you will get the summons from the court and it is your duty to appear before the court after getting summons without fail. If charges alleged against you is false you have to prove the same at the time of evidence.
Thank you
