Help for DUI case Section 185

05-Sep-2023 (In Criminal Law)
Hi I was booked for DUI in early 2017. I pleaded non guilty as I wasn't drunk but had used listerine (mouth freshener) to get rid of smoky smell. I did showed the bottle of listerine to officer & told him I wasn't drunk still he went on booking me for dui. No blood test was done. I missed my last hearing so now online status says NBW issued. My question is 1. What does NBW means ? 2. How do I come out of this case as non guilty ? Is breathanalyzer sufficient to prove that I was guilty ?

NBW means non bailable warrent. If NBW issued against you, police can attest you and produce before the court. You immediately rush to court and get it cancelled before arrest. If police arrest you, in that case you have to furnished bail in the court. You can contest the case breathalyzer is not sufficient to prove the case.

NBW is a Non bailible warrant which can be cancelled on making a application. You can get rid out of the same once the chargesheet is filed in your case.
Secondly you can also challenge the order of issue process before the higher courts which is quite expensive but faster remedy.
