Grey area of law- need genuine legal advice

16-Jun-2025 (In Criminal Law)
I was with a boy for 1 year who promised marriage and then took me to hotels. He did touch, kiss and removed my clothes. I let him. We not not get physical fully. Once I resisted but he did not listen. He always used to do it. And I let him because I loved. Later I came to know he was using me as and left me. Since penetrative sex did not happen, what does it qualify as? Is there anything as Outrage of modesty as it is done under deceit of false marriage promise? What laws apply?

Yes, even without penetrative intercourse, the acts described may qualify under Section 354 (Outraging Modesty) and Section 354A (Sexual Harassment) of the IPC if done without free consent. Since the consent was given under a false promise of marriage, you may also explore Section 417 (Cheating) or Section 376 (if applicable and proven that consent was solely based on false marriage promise). However, courts evaluate such cases based on facts—whether the promise was genuine or deceitful from the beginning. You can file a complaint with the police narrating all incidents. Evidence like messages, photos, or witnesses can support your claim.

Yes, you can book him under the case of Sexual Assualt, Outraging the Modesty of a Woman, you cannot book him for the Offence of Rale, as no such thing occured! However, the Burden of Proof is now upon you to prove that he promised marriage to you & by using that excuse, committed sexual assault with you. If this would have been a Rape Case, same burden of proof would have shifted upon Man to prove that he did not commit Rape with you!

If for everything your consent was given then directly you cannot blame that person but yes giving false promises of marriage and indulging in any physical activity which is forceful then ofcourse you clearly accuse the person in outraging the modesty of women and with many other sections as well.
