1. What should i do the investigating officer is not taking my evidence n2n. What if my investigating officer is not ready to take my 164 crpc as witness n3. What should i do if public procecuter is helping the accused?

you engage lawyer and put up petition is redy for praying for 164 crpc of confession of statement before Magistrate whenever order is passed then investigation officer have done 164 crpc before Magistrate

engage an advocate and ask him to file an application before the court stating your grievance. Court will allow you in the proceeding if thinks fit and proper. in this way you can approch the said court with your grievances.

you can immediately approach either any criminal lawyer from district court who can help you by serving legal notice upon the IO or in the alternative by making an application before the concerned CJM to direct the IO to accept those evidence. as another alternative after exhausting the above remedies would be to approach the high court and get orders to that effect. on the aspect of PP not helping you it would be open to you to seek change of PP for your case before the concerned court or directorate of prosecution or can approach the high court to get order to that effect. provided you carry evidence to show the accusations against such PP otherwise the courts will not entertain your plea. if you are satisfied with my answer you can consider paying me fees at my upi address; advtan@upi regards, Tanmoy Chattopadhyay, M.Sc (Net), LL.B (Delhi), Advocate, High Court, Calcutta.
