For FIR Filing through NALSA portal Legal Aid Services

I want to file a petition under 156(3) CRPC for to get an order for filing a FIR against accused. As I'm a student and having no income, i applied through NALSA portal for free legal aid services. DLSA Aligarh have appointed an advocate. But the advocate demand money for Vakalatnama, tickets, etc. and asked Rs. 1000/- for typing of plaintiff, affidavit, etc. It is legal for advocate for doing the professional misconduct by demanding the money on the application through Legal Service Committee.

Thank you for sharing your concern. Under the Legal Services Authorities Act, 1987, legal aid provided through DLSA/NALSA is completely free for eligible persons, including students with no income. An advocate appointed under this scheme cannot demand money for any purpose including Vakalatnama, drafting, affidavits, or any other document preparation. What you have described amounts to professional misconduct. You are advised to lodge a formal complaint with the Secretary, District Legal Services Authority (DLSA), Aligarh, in writing or through the NALSA portal, attaching any proof of such demand. Strict action can be taken against the advocate including removal from the legal aid panel. Legal aid is your right, and no advocate has the authority to demand any fee from you under this scheme.

if the advocate is charging you fees it is right 1000 is the bare charges which can amount to 10000 you have filed a petition section 156 crpc for getting an order while filing for an fir 156 )3 advocate doing misconduct report bar council of india

Under the Legal Services Authorities Act, 1987, legal aid provided through DLSA is completely free for eligible persons. Advocates appointed under this scheme cannot charge any fee, including for vakalatnama, affidavit, petition typing, etc. If the advocate is demanding money, it amounts to professional misconduct. You should immediately file a written complaint to the Secretary, DLSA Aligarh, and may also escalate it to the State Legal Services Authority. You can also email your grievance via the NALSA portal. Such actions are taken seriously and can lead to cancellation of the advocate’s empanelment and disciplinary proceedings by the Bar Council.
