FIR Under BNS 125 & 286 due to political pressure
16-Dec-2024 (In Criminal Law)
There was a slight gas leak (allegedly) that affected nearby villagers. Approx 20 to 30 kids reported sore eyes and throat and was taken to the nearest clinic but nothing else happened. This issue got bloated up due to political pressure. Police had to file an FIR and 4 people were named in the FIRÂ (BNSÂ 125Â &Â 286). The FIR doesnt mention the company name under accused only my relative. My relative is retired and doesnt have any executive powers so hes forecefully been blamed, what to do next?
Under the Bharatiya Nagarik Suraksha Sanhita (BNSS), your relative can seek Anticipatory Bail under Section 482 (3) to prevent arrest, as he has no Executive Powers and is retired. A Quashing Petition can be filed in the High Court under Section 528 BNSS to challenge the FIR, especially since it appears politically motivated and does not name the company. You should submit evidence proving his retired status and lack of involvement in the incident while also requesting a proper investigation to identify the actual cause and responsible parties.
