FIR is registered under Section 376(1) IPC. However, since the accused is a retired police officer and there are attempts to delay arrest, a petition under Section 156(3) CrPC will be filed before the Magistrate for court-monitored investigation. Simultaneously, a writ petition will be moved before the Hon'ble High Court seeking immediate arrest and transfer of investigation to a neutral agency. Also you can submit the complaint to State Human Rights and Police Complaint Authority against the SHO of the Station who is shielding the accused

If the police is not taking any action against the accused you can move before the superintendent of Police for taking action against the accused if the Suran is also not taking any action you can very well file application before the concerned magistrate for seeking appropriate action against the accused
