FIR quashing in case and counter case.

Are there any possibilities that both the FIRs may get quashed in a High court bench in the same case? The party against us has approached HC bench first,then we followed the same process.His/her stay application admitted and our's is still pending before the court. We fear his FIR may get quashed and only we have to wander to courts and office thereafter. One of our family members is waiting for an appointment order from the government. Kindly enlighten us. Regards.

Yes both FIRs can definitely be quashed by the High Court if they arise from the same incident and lack merit or if a mutual settlement is reached later You should file an application to club both matters together so they are heard simultaneously by the same bench The admission of their stay application does not mean your case is weak since yours was filed later and is simply awaiting its turn to be heard Your advocate can highlight the cross case nature during the next hearing to ensure equal protection and prevent any unilateral relief that affects your family members government appointment prospects keep track of the listings and request the court for a joint hearing of both petitions
