If the police are not taking action in your case, here are some steps you can take to escalate the matter:
File a Written Complaint: Submit a formal written complaint to the police station where the case was registered. Mention all the details, including the suspect's name, past incidents, and the current situation. Keep a copy for your records.
Approach Higher Authorities: If the local police are unresponsive, escalate the matter to senior officers like the Superintendent of Police (SP) or Commissioner of Police. You can also submit a complaint to the District Collector if needed.
Gather Evidence: If you have any proof (CCTV footage, witness statements, previous police complaints, etc.), collect and organize them. This will strengthen your case.
Legal Action: If the police still fail to act, you can file a private complaint in the local magistrate court under Section 156(3) of the CrPC to direct the police to investigate. A lawyer can help with this process.
Human Rights Commission & Media: If there is no action even after escalation, you can approach the State Human Rights Commission (SHRC) or National Human Rights Commission (NHRC) and even the local media to put pressure on authorities.
RTI Application: You can file a Right to Information (RTI) request to ask for the status of your case and why no action has been taken. This often pushes police to respond.
Since the suspect has been found and has a history of similar crimes, you have strong grounds to demand action. Try these steps, and if needed, consult a legal expert for further guidance.
