FIR against me under IPC 279, 337, 338

19-Feb-2023 (In Criminal Law)
A CRPF lady officer fell unconscious front of my car at a turning. Because of traffic, cars were waiting for way bumper to bumper and the lady was in a blind spot and came under my wheel. There was no zebra crossing there, nor was i speeding because it was a traffic jam. I took her to hospital, she suffered a fracture, but all expenses of tests and treatment were taken care of. But because of her job profile she and her family are using their network to force money out of me and filed an FIR saying i was speeding. Now i have a court summon. What do i do?

You need not worry…it’s just a summon…just attend the court on the time and date as mentioned in the summons and put your grievances in front of the magistrate. And if the FIR has already been registered then the chargesheet will be filed by the police. For more legal assistance I am just a call away.

Dear client You’ll need to appear and take a bail, this would be the first step. Once bail is granted the trial will proceed, charge sheet will be filed and so on. During this period, you may proceed to file a quashing, else you may also look at getting the offence compounded. Since FIR has been lodged, the procedure will have to be complied with before the court. Feel free to get in touch for further discussions

You need to hire an expert advocate in this regard. We need to first move the complaint regarding threats n extortion & Apprenshion. Thenceforth, we need to check the sections of FIR. If u have not got the bail, then we need to move bail application. We need to do argument in the court at the time of framing of charges and fight the case. We can also analyse the compoundable part n even quashing too ! Plz feel free to b in touch with us. Thanks

1. Kindly complete details of the case file against you for proper legal advise. 2. my best guess is that sections 279 and 338 of the Indian penal code have been avid against you which entail causing previous hurt by rash and negligent driving. 3.you would have to appear in court and defend yourself of the charges levied against you. 4. you must engage a lawyer to defend you as causing hurt by rash and negligent driving is a serious offence punishable by imprisonment. 5. for further queries feel free to contact me.

Going through your facts, it appears that your case is a made up case by Police under the influence of the complainant. If you are right and you have all the records of your statement, you can proceed with the case on merits and prepare a good defence.
