if money didnot get recovered as this has been lost during incident and accused financial condition as he has been dismissed from job since unable to depisit the money lost.what will happen finally as he has nothing to pay as restitution or fine.
Section 409 IPC is criminal Breach of trust by banker or public servant etc. it is a serious cognizable offence punishable with imprisonment for life or imprisonment for ten years plus fine. Even if the accused has nothing to pay as fine or restitution the imprisonment will still be there.
