Filling of FIR under SC/ST act

I have sent an e-mail to Delhi police to register a case under sc/st act on 31.05.2025. After howmany days I can approach to Court if police does't take any action?

If the police SHO doesn't take action you cannot directly file a case in the Court. After 3-4 it's best to thereafter send a rightly drafted Written Application ( best if drafted by a criminal lawyer) to the DCP so that the Application ensures all elements required as per law. After 3-4 days or at best a week you can file the court case through your lawyer.

Firstly, we will have to see if the email is sent to correct authority and all procedures under the Act have been followed before approaching court. Thereafter, we can approach. There js no specific number of days specified under the act. We only have to show that sufficient time has gone.

You can always get your file ready through an advocate and file a petition under section 156(3) CrPC for registration of FIR against the culprits. There is no particular time frame but usually it should be filed after a gap of 15 days.

There is a full process to go to the court which has to be followed before approaching the court. If the police doesn’t register your complaint then you write a formal written complaint to the concerned DCP or SP. If they also don’t take any action on your complaint then you can approach the court. There is no strict timeline for this, but it is advisable to take quick action otherwise you will have to explain the delay if it’s a lot.

If police fail to act on your SC/ST Act complaint within 15 days, you can approach the Magistrate under Section 156(3) CrPC for directions to register FIR. Keep a copy of your email as proof of intimation.
