Filing separate Consumer compliant on PVT Bank after section 420

Hi, i would like to know whether a consumer can still file a compliant in Consumer court and context in PIP after filing the complaint against PVT bank in RBI Bank Ombudsman and also filed the FIR in PS under Section 420 & 406, whether consumer court consider this as a separate case altogether or will it rejects considering the fact that RBI/ section 420 is underway and will not accept. If it is still applicable to file in Consumer court, whether there are any judgements supporting this. Rajesh

Dear client, yes, you can still file a consumer complaint against a bank even after filing with the RBI Ombudsman and lodging a criminal FIR, but there are limits. Consumer fora have concurrent jurisdiction to decide claims of deficiency in service and compensation; filing with the Ombudsman does not automatically bar a consumer complaint.
