An my person who is staying vocationally next to my house where that house not belongs to her. She is filed false complaint on my parents and it is reputing for every 3 months. police are not event doing investigating on fact. Whenever that lady goes to give compliant police are taking. When we give compliant police are not registering.
Can you pls help me on this. How do I fight in this.
Hi...you request the police not to entertain such false complaint from the lady and not to register ang false case against him and his family members .if police repeat the same you will complain the same to higher authority.

Hi, with reference to your query, first check on what offences are committed. If it's non cognisable, they are right in refusing to register the FIR. If the offence is cognisable, they have to register the FIR. Now because they are refusing to register the FIR, you have to serve them a written complaint and copy of which is also to be dispatched to ACP, DCP and Commissioner of Police ( Superintendent of Police, if it's rural area). This is necessary for reason that, since police has refused to register the FIR, you can now approach Magistrate Court and file a petition seeking directions under section 156(3) crpc. Once Magistrate positively passes this order. Police will have no option but to register the FIR.
