Father recognized neighbour as thief he filed defamation case

Sir. One day a thief came to my home bt sucess to escape but my father recognize him and father doubted one of our neighbour..but my father didn't do anything with him. But the thief file a case on my father for doubting him as a thief....sir what should be the legal decision ? Sir now who is punissable for that case my father or the thief? Please help me sir..
Prosecution has to prove his case beyond reasonable doubt...which is nt at all possible here..dere is no mens rea...so not to worry...y will ur father b punishable...dere is no proof dat ur father has done sumthn
