False FIR is chargesheeted in court

07-Sep-2024 (In Criminal Law)
A woman filed a false FIR against me under IPC sections 506, 509, and 354C. The issue started after I reported her illegal construction and unauthorized CCTV installation to authorities (DM, DCP, MCD), which led to the demolition of her unauthorized work. She now holds a grudge and is seeking revenge. I have proof of my complaints made weeks before her FIR, but she has photos of me allegedly watching her terrace(illegal construction) and making videos of her CCTV. Whose case is stronger?

If you had already filed complaints before the FIR then you should show them to the court to gain the benefit of the case in your favour. If you are under the fear that police might arrest you then you can approach the court according to your jurisdiction and apply for the anticipatory bail. For more legal assistance I am just a call away.

As stated by you, the women does not have any other evidence except for a single instance of you looking towards her terrace. In this circumstance the Case could be dismissed at the stage of taking charges.

It all depends on the circumstances. Outcome of the case depends on various aspects and mind it, cases are more than often won on the ground of technicality rather than on merit, so be wise in appointing a good lawyer, once a good advocate is hired , you should understand that half the battle has been won

Dear sir, it is too early for me to make a comment without having a close look into the actual facts of your case. Having dealt with matters related to MCD, DDA and also dealing in criminal cases, I can tell you that it is the advocate's expertise how he presents your case before the Hon'ble Court. You may consult me though.

no worries as your case is much stronger and since you were on your property so there is no violation of her private property as well. As per the case instituted under 506,509 and 354(c)..it will be very difficult for her during the evidence part and since your case is the first one so you have a stronger point
