false dog biting case against me leading to police complaint

22-Jul-2025 (In Criminal Law)
can FIR be filed by the complainant if the dog bite is not visible or just a scratch where there is no evidence that the dog bit. Just a medical report stating they took injections for dog bite. Also where there was no negligence on behalf of dog ownr. Dog was on lease under control and with muzzle on. Can the FIR still be filed basis all these facts. Also where the prime objective of the victim is to claim money or damages. How to prove the same so that police does not file FIR

It’s totally on the medical report , what doctor prescribes and write in the report. If there is damages caused to the complainant body by the dog then owner is absolutely and FIR will be lodged against the owner .

section 289, 337 IPC can be imposed correspondingly new acts if the injury is severe. but practically as per your facts they may not register FIR, previous history of dog bites, vaccination, negligence, civil damages, nature of injury from witnesses, evidence gathered is seen.

In India a FIR can be filed under Section 155 of the CrPC for a non-cognizable offense like a minor scratch, even without clear bite evidence, if the complainant provides a medical report. However, if the dog was leashed, muzzled, and under control with no negligence, criminal liability under Section 289 IPC (negligent conduct with respect to animals) is unlikely. If the victim's intent is monetary gain, an FIR may still be filed.
