14-Aug-2023 (In Criminal Law)
Hi sir,nIn case of cyber crime complaint, does investigation officer (IO) finally acknowledge the complainant all the sections of IPC to be filed by him before filing chargesheet after completion of investigation? OR does he directly file the chargesheet without acknowledging the complainant about the sections he mentioned in th chargesheet?

Investigation officer on the facts & contents adds sections in the FIR, he doesn’t take any approval from complainant in this regard, if u are not satisfied with the charges, then u need to hire advocate in this regard who will do arguments during the framing of the charges…plz b in touch

As a matter of fact the complainant should be well aware about the facts and the sections that is to be levied on the accused person. The police official is also duty bound to make aware about the same to the complainant or it’s authorised agents. For more legal assistance I am just a call away.

Hi, traditionally the Investigating Officer records the complaint and on the basis of the same draws up a list of all offences that appear to have been committed based on the complaint. Thereafter once investigation is complete a chargesheet is filed containing a list of all charges that appear to be made out post investigation.
