Does charge frame against accused 1 or nBW can be recall by court

In a criminal case , there is two accused no. 1 move discharge application in CJM court which was reject and it's revision also reject by session court then accused move to high to challenge the discharge order which was pending . Where case put on hearing for charge in CJM . Accused no. 1 appear but accused 2 not appear . Court issue NBW against accused 2 . Then when on next hearing at CJM nBW against accused 2 recall or send To JC .Does charge frame against the accused 1 who petition pending.

No charges can not be framed without all the accused Charges can only be framed after the arrest of all the accused in the case There are lots of legal remedies and options available for you Where are you from? You should consult an advocate personally for more details Thank You
