You have the right to peaceful enjoyment of your home, and while normal market noise during business hours may be unavoidable, construction, repair work, or the use of loud machinery late at night can amount to a public nuisance and may violate local noise pollution rules. You should first make a written complaint to the local police station and the municipal corporation, requesting action against the repeated late-night work. If the authorities fail to act, you may approach the appropriate court seeking directions to stop the nuisance.

You have multiple legal remedies for noise pollution violations: The shops’ nighttime repair/construction work violates the Noise Pollution (Regulation and Control) Rules, 2000, which restrict construction/repair activities to 6 AM–9 PM in residential/mixed-use areas; nighttime operations at 11 PM are illegal. Your first step is file a written complaint with the Maharashtra Pollution Control Board (MPCB) citing specific dates/times of violations—MPCB can conduct sound audits and impose penalties (₹1,000–₹1 lakh per violation under Environment Protection Act). Simultaneously, lodge a police complaint under IPC Section 268 (public nuisance) or Section 336–337 (causing danger/injury by act endangering life); even though the shops claim business necessity, operating at prohibited hours is actionable. Contact your local Municipal Corporation (Nagar Nigam) to file a noise

It’s simple always dial on 100 no and tell them that my brother/ relative / friend is an advocate and he/she will be filing an RTI to check what actions have been taken against them (to 100 number you have to say this) every time and actually hire an advocate and get an RTI application made..
