Discharge petition in sessions court


16-Aug-2024 (In Criminal Law)
Sessions Court Judge has instructed to come for examination of accused by next hearing to proceed for trail. Can I now file discharge petition and what is the timeframe for filing such discharge petition. Is it advisable to go for quash petition in HC or discharge petition in sessions Court as I have sufficient proofs to prove my innocence in alleged chargesheet

hi Felix here I can well understand your concern from the query raised .you need to understand that a discharge petition will take considerable time and undergo the same duration of a trial, quash petition can be filed to quash the charges and proceedings with immediate effect thank you
