There is an FIR under sections 420,468 and 471 IPC against my uncle. Section 511 also they kept. He was falsely implicated in the case as A5 only on a confession statement of A2. Except that statement, no other evidences are there. No Complaint. No aggrieved person. He is trying for Anticipatory bail. As per ARNESH KUMAR GUIDELINES, as all sections intending for 7 years sentence, he should be served with 41A CRPC notice, and the arrest should be avoided. Can we file a write petition in High Cour

Yes, you can file a writ to quash the FIR. Also need to check the facts of the case. Arnesh Kumar guidelines is with regards to marital issue. Anticipatory is the best remedy with the Quashing in the HC.
