DELHI HC copies of quashed FIR case when non-party applies for copies

06-Jul-2026 (In Criminal Law)
Some had mentioned that this answer depends on which court - to be clear, its Delhi High Court. Question is Can non-parties get records of the FIR quashing pleading and petition, if non-party applies under RTI or other inspection/copies route like going to court? Order is available on court website but not the petition. It's matrimonial FIR under Section 498A. I read that anyone can just go the inspection room & easily get the copies, whether certified and/or true copies. Why is that the case?

No one can simply go and get the certified copy/ true copies of my the case. Advocates who were representing the parties can file for the same. other than that, an advocate needs to file his/her vakalatanama in that perticular case to get the certified along with a reasonable excuse to get the copies. Whether a non-party can obtain pleadings in a Delhi High Court quashing petition depends upon the Delhi High Court Rules and the nature of the record, not merely on the RTI Act. While final orders are generally available in the public domain, pleadings such as the quashing petition, reply and annexures are not automatically accessible to every member of the public. A non-party ordinarily has no vested right to inspect or obtain certified copies unless permitted under the applicable High Court Rules or by an order of the Court. In matrimonial matters arising from Section 498A IPC, courts are often more cautious because the record may contain sensitive personal information. Therefore, although in some cases inspection or copies may be granted upon showing sufficient cause and complying with the Rules, it is not correct to assume that anyone can simply walk into the inspection branch and obtain copies of the petition. RTI is also generally not a substitute for the procedure prescribed by the High Court for judicial records, and access is governed primarily by the Court’s own rules and the discretion of the Court where required.

No, it's false information that anyone cannot go to the inspection room or even get the certified copies. The person needs to be counsel for the case to get certified copies of any particular case or for inspecting the documents of a case. The order is accessible through court website but if you want the petition or any other documents for the case you can check with your counsel in order to apply for certified copies.

No, Non parties can't get copies, you have to file an application before the majistrate with appropriate reason. if the court get satisfied with your reason after enough evidence then with the permission of parties the court can provide your copies upon filing appropriate court fee.
