Defamation due to helping a child under POCSO and Juvenile justice Act

09-Apr-2023 (In Criminal Law)
one of a girl student of mine age 16 reported an incident to me that she was sexually and physically abused by her family member which is directly hampering her studies, In this regard I have directed her to inform to the counselor of the school and the school principal and if situation arise call the national child helpline number. in this regard her parents have spread a false rumor that there is some kind of affair between me and the student which is why i am helping her. Due to this when the child wanted to report to the police she was physically forced not to go to the station.Should I file a defamation case against the parents along with any other relevant acts. the concern child is completely agreeing to bear witness in front of court.

yes you should file a defamation suit and also criminal case of abusive remarks . Now the question is whether the girl will be constant to give her statement . Actua6 when it's of criminal defamation it's better to talk or go for confetence

if the victim girl is ready to standby your side as well as the incident happened to her then without giving a second thought you should lodge a complain on behalf of the victim girl before the concerned police station and also before the women's Commission and you may also inform the incident to the superior police authorities. if the complaint stands and further proceeding starts then you will also have strong ground for your defamation case against the family members of the vacuum girl and also the victim girl get justice. thank you

Dear client, you should inform some NGO who works for children alternatively you can inform police unofficially as it's better for you to stay little for from the incident. it takes no time for a child to change their version.
