Cyber issue against putting picture with an ex-girlfriend on FB

suppose my exgirlfriend took a picture of both of us from my cellphone. now we almost no longer talk is it illegal to put the picture as my facebookprofile picture?
is it an obscene picture or a normal picture, secondly facebook has privacy policy from where you can report for the picture to be taken down from facebook. you can personally request the person as well to remove the picture. and the picture is not objectionable you cannot report it as well
