Since your JMFC application for defreezing was rejected and revision is pending before the Sessions Court, first ensure that the revision is actively pursued. File an application for urgent hearing before the present Sessions Judge mentioning delay and retirement of the previous judge. If police are now stating that no balance is available in the fraudster’s account, you should: Seek a status report from police regarding total amount traced, frozen, and transferred. Move an application before the Sessions Court directing police to produce bank statements and transaction trail. If investigation is not proper, you may approach the Hon’ble High Court under Section 482 CrPC (now corresponding provision under BNSS) seeking monitoring of investigation. Additionally, you can initiate recovery proceedings against identified accused once charge sheet is filed. Cyber fraud matters require quick tracing of money trail. Delay weakens recovery chances, so procedural pressure through court is important. If you share amount involved and present stage of charge sheet, more specific guidance can be given.

In a case registered in November 2023 with the North Region Cyber Police Station in Mumbai (FIR No. 97/2023), two accused remained in custody after a sessions court rejected their bail applications in early 2024. The fraud involved fake online job offers and cryptocurrency-related deception, where victims were induced to transfer money on promise of investment gains. The court held the allegations grave and denied bail to prevent interference with the ongoing investigation.

if you are the victim of Cyber fraud and their account has not yet been frozen and they have no lein pending in their account, it means that you won't get any money in return even if you have filed any complaint, and your question is headset contradicting that the jmfc judges saying that their cannot be defrezzed, if the account is freeze you as a complainant are bound to get the money if you'll file return a property application
