In 498A matters, you cannot directly cross-examine the IO before charges are framed. But you can file a discharge application and show the court that the chargesheet is faulty and no real investigation was done. The judge will look into this before deciding charges. Later during trial, you will get full chance to cross-examine the IO and point out all mistakes in the report. 8-3-7-7-0-5-1-6-7-5

A chargesheet can be filed only after a fair, complete, and proper investigation by the Investigating Officer. Investigation must be carried out in accordance with law, ensuring that evidence is collected, witnesses are examined, and relevant documents or materials are seized. The purpose is to ascertain the truth and to determine whether there is sufficient material to proceed against the accused.

It appears that the chargesheet in the present case under Section 498A IPC was filed by the Investigating Officer (IO) without a proper investigation and based merely on collection of marriage photos. The law does not permit cross-examination of the IO before the framing of charges. However, an application for discharge can be filed before the court at this stage, highlighting that the chargesheet is based on insufficient material and does not satisfy the legal requirements of a thorough investigation.
