Criminal Appeal or Criminal Revision
05-Nov-2024 (In Criminal Law)
An application is filed in the Session Court by the complainant to challenge against the final order passed by MM Court u/s 437(5). The opposite party has raised concern whether this application is maintainable. Can you please suggest if this should filed as criminal appeal or criminal revision? Also any reference to some judgments to support.
Sir, appeal is not maintainable in this scenario and only criminal revision would be maintainable. Furthermore, without having a look at your file, it is nearly impossible for an advocate to help you with the relevant judgements here. You may approach the advocate of your choosing so that he can help you with the same.
