Criminal action in case Marriage of minor boy with major girl

Marriage of minor boy with major girl. Boy parents wants criminal action. In this issue both got love marriage. Girl parents accepted. What criminal action attacks. Please clarify?

The offense is punishable u/s 18 of Hindu marriage act and the parties are liable for rigorous imprisonment which may extend to two years or with fine which may extend to one lakh rupees, or with both.

A boy can't marry before completing 21 years of age as per Section 5 (iii) of Hindu Marriage Act, 1955 (Condition for a Hindu Marriage). The marriage between a minor boy and a major girl and a minor girl and major boy is a void marriage. It is natural that the boy's parents may contemplate criminal action against the girl and her family. The boy's parents can lodge a complaint with the police after which an FIR can be registered by the police against the girl and her family under Section 361,366 ( However, sections may differ). Therefore, it is advisable that the boy should complete 21 years of age before he marries to avoid legal trouble.
