Court treated my protest petition as complaint case and 223 and 225 bnss statement record in rape case but I filed revision in session court which was reject and back toh cjm court and case treated as complaint and fixed for talbi bahas, revision order dated 19.09.2025 , what should I do to treat case as state case
You should file 482/528 Application before High Court so it's only option you may now avail it for that purpose you should book a consultation then I'll elaborate properly about that matter herein you may challenge both orders.
to treat a case as state case you have to file a fir which will set the criminal law in to motion your petition treated as complaint case and remanded back to cjm court so you have to appear before the cjm case
you can file an revision or writ in article 227 in high court against the order of revisional court. if higj court set aside order you can request to treat complaint as police report. you can pray before magistrate also
Aapke facts se lag raha hai ki aapne protest petition file ki thi, lekin court ne usse complaint case treat karke aage badha diya aur aapki revision bhi Sessions Court ne reject kar di. Ab aapka matter CJM court me complaint case ke roop me chal raha hai.
Agar aap chahte hain ki case “state case” (police case) ke roop me chale, to aapke paas ye legal options available hain:
High Court me challenge
Aap Sessions Court ke revision order ko Bharatiya Nagarik Suraksha Sanhita ke provisions (old CrPC Section 482 ke equivalent inherent powers) ke tahat High Court me challenge kar sakte hain. Yahan aap yeh prayer kar sakte hain ki matter ko FIR based police case treat kiya jaye aur proper investigation ho.
Direction for registration of FIR
Agar pehle FIR properly register nahi hui thi ya investigation defective thi, to aap High Court me petition file karke fair investigation / reinvestigation ki demand kar sakte hain.
Complaint case continue karna
Agar aap High Court nahi jana chahte, to jo complaint case chal raha hai usme aapko evidence lead karna hoga. Sections 223 aur 225 BNSS (old 200/202 CrPC) ke baad agar prima facie case banta hai, to court accused ko summon karega aur trial aage badega. Is situation me case private complaint hi rahega, state case nahi banega.
Practical position
Law ke hisab se once Magistrate ne consciously protest petition ko complaint case treat kar liya aur revision bhi dismiss ho gayi, to usko state case me convert karwana lower courts me possible nahi hota. Iske liye High Court ka intervention zaroori hota hai.
Isliye aapke liye sabse effective remedy High Court approach karna rahega, jahan aap revision order aur Magistrate ke order dono ko challenge kar sakte hain aur FIR/investigation ki direction maang sakte hain.
you can challenge that order and you have to tell me that on which basis police filed final report and protest petitio has been dejected so i need to read that order if you want help then you can send me your papers then i can help you in better way.
