01-Mar-2023 (In Criminal Law)
few cases were filed like theft against me but the complainant is not alive now and the case is pending in the court for many years. I want to know what will the procedure now can I be convicted for the charges even now because complainant is not alive whose statement is admissible is the court
yes you can be convicted even in absence of the complainant. Complainant's evidence, though important, is not the sole criteria for conviction. If other independent witness corroborates the prosecution version, the court can still convict you.
What happens if complainant does not appear in court in India
dismissal of complaint for non-prosecution
What happens if complainant does not appear in court
Dropping of prosecution witness
non appearance of witness in criminal case
Non appearance of complainant CrPC
Dismissal of 138 complaint due to repeated absence of complainant
Yes you can still be convicted on charges of report given by Investigation officer to court. Yes u can still be convicted even though complainant is dead is u have offence of theft. Witnesses statement and on the basis of evidence provided will be admissible. It will be now a state case or any person from the dead complainant family. But the case will not be disposed off till judgement of the matter is not passed.
