Charge sheet not yet filed by police in court.

05-Oct-2025 (In Criminal Law)
Police hv not yet filed Charge sheet not yet filed by police in court even after 9 months from incidence (suspected murder). They would instead file some other report to court. What could it be? Why are they not filing charge sheet? As already indicated, we hv not filed FIR so far.

Since no FIR has been filed yet, the police cannot file a charge sheet. A charge sheet is submitted only after investigation in a registered FIR case. The “report” they refer to may be an inquest report or closure report if they found no offence. You may approach the SP or Magistrate under Section 156(3) CrPC to seek registration of FIR and proper investigation.

Well, if the Police has not been filing Chargesheet, you can file a case in Court against the concerned Police Officials for not performing their duty, seek a detailed status report that what has been done until now in the name of Investigation!
