CCTV evidence validity without presenting DVR

07-Oct-2025 (In Criminal Law)
CCTV footage collected in USB drive or CD is treated as secondary evidence. But to be admissible as evidence in court. Digital Video Recorder (DVR) must be produced for verification. Is that correct? 65B alone is not sufficient without DVR. The DVR belongs to a small house not part of a commercial building or government property. The DVR has been overwritten several years back and footage doesn't exist on DVR. Only USB or CD is available. Even 65B has no value since original footage is missing.

Dear Sir, Even if a 65B certificate exists, the court may still insist on verifying authenticity, particularly when: The original device (DVR) is available or can be produced; or The copy is challenged as tampered or edited; or The source or process of copying is unclear. If the DVR is missing, destroyed, or overwritten, the question becomes one of probative value, not mere admissibility. That is: The CD/USB may still be technically admissible under Section 65B, But its evidentiary weight (credibility) becomes very low if the original DVR can’t be verified.
