“The matter is pending since May 2026 for arguments/enquiry on the Section 319 Cr.P.C. application, and repeated adjournments have been sought by the respondent side. The main C.C. case itself is pending since 2021. In the interest of justice and expeditious disposal, the petitioner strongly objects to any further unnecessary adjournment. It is therefore prayed that the respondent be directed to conclude their submissions on the next date and that the pending application be disposed of expeditiously. The petitioner further prays that the mandate and spirit of Section 309 Cr.P.C. be kept in view while considering any further request for adjournment.”

Section 309 Cr.P.C. squarely empowers the Court to regulate adjournments and ensure expeditious progress of an inquiry or trial. Repeated adjournments at the instance of the respondent, particularly when the main C.C. case has been pending since 2021 and the Section 319 Cr.P.C. application has remained pending since May 2026, cannot be allowed to defeat the object of a speedy trial. The Supreme Court has repeatedly deprecated adjournments granted merely on the asking of a party and has emphasised that reasons must be recorded for postponement. Therefore, at the next hearing, you may file an application under Section 309 Cr.P.C. seeking expeditious disposal of the pending Section 319 application and requesting that no further unnecessary adjournment be granted. You may also request the Court to fix a short date and decide the Section 319 application before proceeding further with the trial, as applicable. further you can contact me anytime whenever needed I am always there happy to help take care
