If there is repeated adjournment in your case you need to file an application for no reply order along with written objection of exemption and adjournment in both the cases, in case the respondent still not ready for arguments ask for orders and you can also file a writ petition for speedy trial and getting it time bound by the court

Yes. If the Crl.M.P. under Section 319 Cr.P.C. has remained pending since May 2026 and repeated adjournments are being sought by the respondent side, particularly when the main C.C. case is pending since 2021, the proceedings should not be allowed to remain indefinitely pending without sufficient cause. You may file an application under Section 309 Cr.P.C. at the next hearing, requesting the Court to avoid unnecessary adjournments and decide the pending Section 319 application expeditiously, in the interest of justice and speedy disposal.

If you’re in such a lot of hurry then go to high court and get the matter expedited just for the record 6-8 months is not a very long time and it’s depends on what have you filed for in the Miscellaneous petition… And once the trial commences the courts take a long time yes.. people think getting out of the prison is everything but no.. the trial might take up a lifetime

Hey, no proceedings can be kept pending indefinitely unless expressly directed by a court in its order. Therefore, in your situation as well it will have to be argued and decided at the earliest possible date. Although what could be the best possible strategy to move ahead will have to be evaluated considering a detailed analysis of facts of the case.
