27-Jun-2026 (In Criminal Law)
in ongoing 319 hearing, respondent are now claiming that they did not receive the revised petition. However, they have already filed a detailed counter addressing the contents of the petition. The Court docket dated 18.06.2026 records that the petitioner side was heard and the respondent side was heard in part. In these circumstances, does the respondents' present stand appear false and intended only to delay the proceedings and divert attention from the merits? .. how to respond to this court

Yes. If respondents have filed a detailed counter and were heard, claiming non-service may lack credibility. Point to the court record, counter affidavit and seek rejection of delay tactics and hearing on merits as per the concerned provisions of law.

Hello, If the respondents have already filed a detailed counter dealing with the revised petition and the court proceedings also reflect that both sides were heard, their present plea of non-receipt may not be sustainable. You may place these facts on record, produce proof of service, and request the Court to proceed on merits instead of permitting unnecessary delay. Please share the complete case record for specific legal advice.
