cc case 319 crpc detailed answer required interested answer

26-Jun-2026 (In Criminal Law)
in ongoing 319 hearing, respondent are now claiming that they did not receive the revised petition. However, they have already filed a detailed counter addressing the contents of the petition. The Court docket dated 18.06.2026 records that the petitioner side was heard and the respondent side was heard in part. In these circumstances, does the respondents' present stand appear false and intended only to delay the proceedings and divert attention from the merits? .. how to respond to this court

The respondent's claim is an apparent afterthought to delay proceedings. Since they already filed a detailed counter addressing the petition's merits and were heard in part on 18/06/2026, their plea lacks bona fides. Bring these facts to the court's notice to reject the delay tactic as per the concerned provisions of law.

No, from what you are saying, it is apparent that they have received the petition initially you can plead this when they address the court if they say they haven't. Even if they say that they haven't received it then just serve a copy on the next itself and appraise the court that you have already given them a copy and you're giving it again and ask his lordships to record it in the roznama order.
