Caught DRUNK DRIVING- what to do next?

Hi. I was recently caught by Police at nakaa sector 29, Gurgaon. I was under influence and the BAC came to 400. I think they rigged it, as I had only 2 drinks, 3 hours ago. What are the remedies available, and will I get any jail time? This is my first challan. Can I get out of this after only paying fine?

Yes, you can get out of it only by paying fine. You will not be jailed. I also think that the machine was rigged basis what you have shared. Need not worry. You’ll be fine. You can hire a counsel and get the challan paid.

Let me tell you if you get a challan of drunken driving than you can dispose off your challan before the concerned area magistrate in the district court. You must be present before the hon’ble court with your legal representative on the final hearing of your application. After disposal you have to submit the fine receipt in the traffic department for the removal of your challan online from E- Parivahan site.

This is just a challan issued against you, no need to worry, you can pay the amount that has imposed on you or contact an advocate who’d help you with the payment of challan at court, it can either be paid on the online portal but there the challan will be paid in totality ie., Rs10k but at court the amount can be paid in a reduced amount.
