Your petition u/s 482 CrPC has already been admitted and notices issued. The delay is due to non-filing of counter affidavit by the State and Opposite Party, and also heavy pendency in the High Court. In such cases, you may move an Urgent Listing/Take Up Application supported with affidavit requesting the Court to fix a specific date. Your counsel can also mention the matter before the concerned Bench for priority hearing. If despite repeated notices the other side does not file counter, you may seek ex-parte disposal. The matter is not rejected; it is only pending for listing. The proper remedy now is to press your advocate to move urgent listing and mention it before the Court for early hearing.

you can approach the supreme court for the expedite disposal of the 482 crpc. Generally with the listing application, the matter is easily listed for the hearing. Maybe the bench is not able to take up this matter due to the paucity of the time. after Dashara, maybe the bench will be changed.

Ask your advocate to mention the matter before the concerned bench or file a recall/urgency application, explaining that the case has been pending for over a year without progress. You can also check the cause list and case status on the High Court website to confirm if the petition is being listed properly.
