can section 409 be applied to non public servant

my husband waas working with an ngo that is global human rights protection council and they use to help the farmers getting tractors at half the price.the sog has arrested those people and section 409 is added with section 406,420,120b and 114.please guide me that can sec.409 be applied to them as they are not pulic servant or agent or merchant

For proper advice need to read your husbands part in FIR as per law sec 409 of ipc applicable on person who is in public’s services but as per your issue can not give advice without checking your FIR or chargesheet.

Criminal breach of trust by public servant, or by banker, merchant or agent.—Whoever, being in any manner entrusted with property, or with any dominion over property in his capacity of a public servant or in the way of his business as a banker, mer­chant, factor, broker, attorney or agent, commits criminal breach of trust in respect of that property
