Can panchanama be modified or will the matter be dismissed
17-Nov-2024 (In Criminal Law)
5 witnesses went to police station to file complaint u/s IPC 354. Panchnama was filed without police visiting scene of crime. Police case was filed in Magistrate court. The Panchnama mention date that police says they visit the crime scene. That date of visit of crime scene -- that day the crime closed for religious holiday -- this fact is indisputable. Police hurried and filed panchnama without visit to crime scene. Will judge throw out matter or allow police to amend panchnama
In your situation, where the police filed a panchnama (a report or documentation) stating that they visited the crime scene on a particular date, but the crime scene was closed due to a religious holiday on that day, it raises serious concerns about the authenticity and accuracy of the panchnama. The fact that the police didn't visit the scene on the stated date could affect the credibility of the investigation.
