Hello,

What are the terms and conditions of the agreement of sale of the property? Is there a cancellation clause in the agreement of sale? If yes, then send a legal notice to the party and tell them that you want to cancel the agreement of sale in view of their subversive and illegal activities and demand them to pay the token advance amount taken from you. However, if there is no cancellation clause in the agreement of sale, file a suit for specific performance in the civil court of the jurisdiction where the property is situated and pray for a direction from the court to direct the party to fulfill the conditions of the agreement of sale and further direct the party to register the property. In addition to this, file a stay petition in the same court praying the court to restrain the party to sell, lease or mortgage the property to others pending the disposal of the specific performance suit. Coming to your query, as you said, you can file a cheque bounce case if the cheque the party issued bounces and you can also file a cheating case under Section 420 IPC and 406 for Criminal Breach of Trust. Feel free to contact me if you need any help and assistance.
